I am Jack Powell... I’m a Birmingham-based photographer specialising in portraiture and lingerie photography. I studied photography at the University of Portsmouth, where I developed my artistic vision and technical skills. In 2016, I launched my brand, Jack Powell Photography, to encompass all aspects of my work, while also creating BLUSH to post explicit style images.

My approach to photography is driven by an aesthetic sensibility, capturing anything that resonates with me visually. Whether working in the studio or exploring urban settings, I aim to showcase the beauty and individuality of my subjects.

Terms & Conditions Information

 

Please ensure you read and understand the terms and conditions prior to booking or accepting a photoshoot opportunity. The terms and conditions are no negotiable without prior agreement of the photographer unless the photographer (Jack Powell / BLUSH) agrees with documentation. 


 

Throughout the following document the following regards the photographer as Jack Powell also under the brand BLUSH. In extension the Client will be in regards to the model or company who has commissioned the photographer or takes part in a photoshoot by the photographer (Collab or Invitation).

 

Acceptance 

All contracts and bookings will proceed on the basis and understanding that the terms and conditions are read, understood and accepted by the client. Any adjustments to the terms and conditions must be accepted by the photographer and re-documented prior to the shoot. Prior to shoot, the photographers style will be the result of content and artistic style must be revised and accepted by client. If the client does not accept the terms and condition set in place then the shoot can not go ahead.

 

Copyright

All content and material created by the photographer is owned by the photographer under copyright law (Copyright, Designs and Patents Act 1988). The photographer may use content for own use, brand use or publications or promotion.

 

Client Use 

Use of content must be discussed and agreed by the photographer prior to shoot and must be credited with all uses of the media. In addition to the use, media must not be re-edited and published without agreement of the photographer. All original copies of the images (RAWs) will remain with the photographer and not sent. (Only edited files will be sent)

 

Pricing

Pricing of the shoot will consist of the photographic service provided with equipment, Travel expenses, Location Rental (if applicable) Post-Production and Insurance contribution. The price is a combination of many factors and the price will be fixed once agreed. The agreed price will not change once the booking is fulfilled and locked in. Any bartering will not be accepted by the photographer.

 

Additional charges

Alterations to agreed terms or brief, additional requests for the shoot, any required licensing or permissions required for the shoot or content. Any charges from a third party remain with the client and the photographer is not liable (e.g. Make up, stylist, studio or space rental, model etc.)

 

Deposit

 A non refundable 50% Service deposit is required to secure the booking and until paid, any plans are unsecured. The cost of any external factors (e.g. location) must be settled prior to the shoot and the photographer is not liable for any issues of location or rental. Any change of date due to location rental will require a re-booking for next available date and charges may apply based on notice given to the photographer.

 

Payment

Payment for the shoot requires the initial deposit to be paid by bank transfer or paypal. The remainder payment is to be sent by the same method after the shoot and content will not be released until payment is received. The full price must be paid to receive the images and content. If payment is not given then action will be taken. Payment for booking  is also confirmation of the acceptance of the terms and conditions..

 

Cancellation 

Cancellations, No Shows or breach of agreement will lose deposit. (A breach of agreement is a change made by the client outside what was agreed prior to the shoot or a breach of the accepted terms and condition, The photographer has the right to cancel due to this un-agreed change)

 

Postponement

In the unforeseen circumstances of the photographer (Illness, Pandemic, Travel issues, harsh weather or grievances) the photoshoot will be postponed or cancelled. The photographer will refund the client due to it being on the photographer's behalf. (This does not include a breach of agreement)

 

Health and Safety

The health and safety during a shoot is very important and a breach of this could lead to a cancellation prior or on the day. The expectations of the photographer is to undergo the services in a safe environment. It is the responsibility of the client to undergo safety during the commission. During the shoot the expectation of the photographer is that all attendees of the shoot have consented to what has been agreed during the booking process. Attendees must be over 18 with a signed consent form for the photographer (to be filled out prior or on the day). 

During the photoshoot attendees, client or company must not be under the influence of any substances (Drugs) and smoking to not take place in the shoot space. Alcohol may be consumed under moderation (small amount). A breach of this will lead to an on the day cancellation with full payment expected or action will be taken. All procedures during the shoot must abide by law and at any point the photographer feels unsafe or a breach of terms has occurred then the shoot will be terminated without refund. All on site participants are under the liability of the client. The photographer is not liable for any accidents during the shoot.

 

Delivery

The content created will be edited at an estimated time after the shoot depending on volume, demand and current workflow. A definite timescale cannot be given to the client but the post-production can be estimated to give the client a rough idea and this must be taken into account before the booking. The client must agree not to send multiple requests before or after the estimated time scale as this creates an obstacle during the process. Once completed, the files will be uploaded into an online document and sent to the client, only the client will receive access and additional access will be denied. Once the client has access please download and save the files in a safe place as the folder will not remain online forever due to memory capacity and once deleted the files will not be re-uploaded.
